The Acceptable Use Policy will always be available for your reference via the link in the site's footer. ZeroGain will endeavour to notify users of changes to the AUP in advance, but reserves the right to change the AUP at any time without warning or notice should the need arise. By using this site you agree in advance to accept any changes as of the date they are made.
Introduction
The ZeroGain forum is a non-profit discussion area for people interested in hifi and music of all kinds. This forum is not connected to any organisation involved in audio retail, manufacturing, or reviewing - this is not to say people involved in these areas are not more than welcome to contribute here. They are. However, gratuitous free advertising dressed up as posts is not welcome. This forum is totally independent and not affiliated to any particular hifi ideology. Flat earth or round and anything in between are welcomed.
The ZeroGain forum believes strongly in freedom of speech, and will only be moderated as a last resort - flame wars / stand wars / off topic stuff such as politics / racism / religion / personal insults etc. Full terms and conditions relating to forum participation are detailed in the ZeroGain user agreement section of this document.
The ZeroGain User Agreement
Usage of the ZeroGain forum is reliant upon your acceptance of the following terms and conditions. By participating in this forum, you acknowledge your full acceptance of these terms.
Rules of Conduct
A forum member shall not post or transmit through ZeroGain any defamatory, threatening, obscene, harmful, pornographic or other material which would violate or infringe in any way upon the rights of others, or which would give rise to criminal or civil liability and / or violate federal or local law or regulation. You may not transmit materials which encourage conduct that constitutes a criminal offence.
A forum member shall not upload, post, or otherwise make available on the ZeroGain forum any material protected by copyright, trademark or other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right.
Aliases
Whenever you post a message on this forum your alias will automatically appear with your message. You may choose any name to use, however, you may not use a user name (or e-mail address) that attempts to impersonate another person or that ZeroGain deems to be offensive. The use of multiple identities is not permitted. Any users found to be using multiple identities for posting will have their posting rights restricted.
Trade Sellers
Trade sellers must not promote their products on the main forum. There is an allocated space for this. Trade members may only advertise on the trade ads pages. It is not permitted for trade sellers to tout for business using the PM system.
Other members must not push Trade members products on their behalf. Posts doing this will be deleted, and persistant offenders may be banned
Banned members
If any member has been removed from the forum for whatever reason they should no longer be the subject of any discussion, this is only fair as they no longer have any right of reply.
The audio community
ZeroGain sits harmoniously in the audio community along with many other audio forums, as such it is not acceptable to bring any personal argument from another place onto ZeroGain.
Rights of ZeroGain / Disclaimer of Liability
ZeroGain is a distributor only (and not a publisher) of its interactive community. The content is supplied by the forum member with occasional responses from ZeroGain. ZeroGain shall not be responsible for policing, monitoring, or editing such content, exercises no more editorial control over such content than would a public library, bookstore, newsstand, or other distributor of content, and accordingly, shall not be responsible for exercising editorial control over such content. ZeroGain shall have the right, but not the obligation, to monitor all content in order to respond to or comment upon communications by forum members and in order to determine compliance with the foregoing rules of conduct. ZeroGain shall have the right and sole discretion to edit, to refuse to port or to remove any content whatsoever which it finds to be in violation of this AUP, or which it finds in its sole discretion to be otherwise objectionable for any reason.
The opinions expressed in the message boards are not necessarily (and in some cases not at all) those of ZeroGain. ZeroGain is not responsible for any materials provided by members which are deemed harmful or offensive to others. ZeroGain is not responsible in any way for any injury, loss, or damage which occurs as a result of an opinion expressed or information provided in these sections of the site.
ZeroGain makes no warranties, express or implied, as to the content in the ZeroGain site or the accuracy or reliability of any information or statements contained therein. All statements, advice and opinions made by forum members on this forum are those of the members only. ZeroGain neither endorses nor shall be held responsible for the reliability or accuracy of same. This also covers any DIY projects, both with regards to their suitability for intended purpose and electrical safety. ZeroGain can not be held responsible for any injury or damage resulting from the modification or construction of any electrical or electronic device discussed by members of the forum.
ZeroGain forum member's indemnification / obligations
The forum member agrees to defend, indemnify and hold harmless ZeroGain and affiliated companies against all claims, losses, costs, and expenses (including legal fees) arising out of a forum member's use of ZeroGain sites, or arising out of any violation of the stated rules of conduct by a forum member including, without limitation, any communication by forum member which is claimed to be defamatory, obscene or otherwise unlawful, which is claimed to violate the copyright, trademark, proprietary or other rights of third parties, or which constitutes a submission of materials.
